Check your Deputyship Order now – it may expire shortly

Your Deputy Order may contain a time limit after which it will expire and can no longer be used. This is significantly more likely if you were previously known as a Receiver.

It is therefore essential that you check your order immediately.

If your order does contain a time limit and is due to expire shortly, you should make a new application to the Court of Protection.

Any such application should be made on Court form COP1 and will need to be supported by:

  • COP1A  -  Supporting information for property and affairs applications.
  • COP3 - Assessment of capacity (An up-to-date assessment of capacity is needed so that the Judge can address the issue of ‘capacity’ for the application in question)

If the Order has already expired, a COP4 (Deputy’s declaration) form will be needed in addition to the forms above. An application fee of £400 will also be applicable unless the conditions for exemption or remission of fees apply.

In most cases the Court is currently issuing orders within 14 weeks of receipt of an application.
