Lasting Power of Attorney

Sometimes people wish to plan ahead and set out in advance what they would like to happen should they become unable to make decisions for themselves in the future. A Lasting Power of Attorney (LPA) is an important legal document that enables a person who has capacity and is over 18 (Donor) to choose another person or people (Attorney(s)) to make decisions on their behalf. There are 2 different types of LPAs:

  • A property and financial affairs LPA is for decisions about finances, such as selling the Donor’s house or managing their bank account; and
  • A health and welfare LPA is for decisions about both health and personal welfare, such as where to live, day-to-day care or having medical treatment.

An Attorney is appointed to make decisions as if they were the Donor themselves. An Attorney must act in the Donor’s best interests and have regard to the Code of Practice.

An LPA must be registered with the Office of the Public Guardian (OPG) before it can be used. An unregistered LPA will not give the Attorney any legal powers to make a decision for the Donor. The Donor can register the LPA while they have capacity, or the Attorney can apply to register the LPA at any time. A fee of £120 is charged for registration of each Lasting Power of Attorney application. Cheques should be made payable to 'The Office of the Public Guardian'. Useful information about the Lasting Power of Attorney packs

The two packs below contain the forms and guidance material that you need in order to make and then register a Lasting Power of Attorney.

They are packaged as ZIP files. Most modern computer operating systems should allow you to open this type of file. However if have any problems opening ZIP files then then please contact us for further advice or download the individual files you require from the All forms and guidance section of our website.

The forms and guidance contained within the packs are PDF files, to view these files correctly you should download the latest version of the free Acrobat Reader software. Our related links menu provides useful links to the Adobe website where you can download this software.

Large print versions of our Lasting Power of Attorney forms and continuation sheets are available from the Office of the Public Guardian forms section of our website.

For customers who are blind or partially sighted and use a reader on their PC, we have the LPA creation forms (the instruments, the continuation sheets and the spare Part C) available in Word format for completion electronically. These are not available on the website so if you need these forms please call our Customer Services on 0800 456 0300 or e-mail them at customerservices@publicguardian.gsi.gov.uk, and they will email a set to you.
