A Lasting Power of Attorney (LPA) must be registered with the Office of the Public Guardian (OPG) before it can be used. An unregistered LPA will not give the Attorney any legal powers to make a decision for the Donor. The Donor can register the LPA while they have capacity, or the Attorney can apply to register the LPA at any time.

An Enduring Power of Attorney (EPA) must only be registered when the Attorney believes that the Donor is becoming or has become mentally incapable of handling his or her own affairs. These are only valid if they were made before 1 October 2007.

The Lasting and Enduring Power of Attorney registration packs

The two packs below contain the forms and guidance material that you need when applying to register either an LPA or an EPA. These registration packs are provided as ZIP files. A fee of £120 is charged for registration of each Lasting Power of Attorney or Enduring Power of Attorney application. Cheques should be made payable to 'The Office of the Public Guardian'. Important: Please note that these forms are for registration of your LPA or EPA only. You will also need to include either a 'Lasting Power of Attorney for Property and Financial Affairs (the instrument)' form, a 'Lasting Power of Attorney for Health and Welfare (the instrument)' form or an 'Enduring Power of Attorney' form. Both of these LPA forms are available on this site.
